1. Who we are

PostGenius AI (the "Service") is operated by Eduardo Esteban Villablanca Labra("we", "us", or the "Seller"), an individual based in Chile. By using the Service, you enter into a contract with the Seller.

2. Acceptance

Your continued use of the Service means you accept these Terms. If you do not agree, you must stop using the Service.

3. Service description

PostGenius AI is an AI-powered tool that helps users generate social media post copy, AI cover images, draft libraries and calendar planning through prepaid credit packs.

4. Acceptable use

You must not use the Service to:

• Conduct illegal, fraudulent, deceptive or harmful activity.
• Create or distribute spam, phishing, malware, scams or automated abuse.
• Generate hate, harassment, sexual exploitation, self-harm or violent extremist content.
• Create non-consensual deepfakes, impersonation, deceptive political content or unlawful synthetic media.
• Infringe third-party intellectual property, privacy, publicity or confidentiality rights.
• Probe, scrape, overload, reverse engineer or interfere with the Service or its security.
• Resell, sublicense or redistribute the Service without our written permission.

5. AI-generated content

You are responsible for your prompts, for how you use generated outputs, for verifying their accuracy, and for ensuring you have the rights to any input content you submit. AI outputs may be inaccurate and are not legal, financial, medical or other regulated professional advice. We may filter, refuse, remove or restrict content and suspend accounts that violate these Terms or applicable law.

6. Intellectual property

The Service, software, documentation, brand and related intellectual property are owned by the Seller. We grant you a limited, non-exclusive, non-transferable licence to use the Service according to your selected plan or credit pack. You retain rights in your own inputs and are responsible for ensuring that you may lawfully use any outputs.

7. Payments, billing and taxes

Paid credit packs are processed through PayPal. Prices are shown in USD and purchases are one-time credit packs, not subscriptions. You are responsible for any taxes, bank fees, currency conversion costs or local obligations that apply to your purchase or use of the Service.

9. Service level

We do not guarantee uninterrupted, secure or error-free operation. To the fullest extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid for the Service in the previous 6 months. We are not liable for indirect, incidental, special or consequential damages, loss of profits, loss of data or loss of goodwill, except where liability cannot lawfully be limited.

11. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, unlawful activity, repeated or serious policy violations, or misuse of the Service.

12. Governing law

These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the competent courts of Chile.
